IL CONSIGLIO DELL'UNIONE EUROPEA,	THE COUNCIL OF THE EUROPEAN UNION,
visto il trattato che istituisce la Comunità europea, in particolare l'articolo 175, paragrafo 1, in combinato disposto con l'articolo 300, paragrafo 2, prima frase e paragrafo 3, primo comma,	Having regard to the Treaty establishing the European Community, and in particular Article 175(1), in conjunction with Article 300(2), first sentence of the first subparagraph, and (3), first subparagraph, thereof,
vista la proposta della Commissione(1),	Having regard to the proposal from the Commission(1),
visto il parere del Parlamento europeo(2),	Having regard to the opinion of the European Parliament(2),
considerando quanto segue:	Whereas:
(1) Il 24 giugno 1998 la Comunità ha firmato ad Aarhus il protocollo della convenzione del 1979 sull'inquinamento atmosferico a grande distanza relativo ai metalli pesanti (in seguito "il protocollo").	(1) The Community signed in Aarhus on 24 June 1998 the Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Heavy Metals (hereinafter "the Protocol").
(2) L'obiettivo del protocollo è controllare le emissioni di metalli pesanti causate dalle attività antropogene che possono spostarsi nell'atmosfera a grande distanza attraverso le frontiere e che possono avere effetti nocivi significativi sulla salute umana o sull'ambiente.	(2) The Protocol aims at controlling emissions of heavy metals caused by anthropogenic activities that are subject to long-range transboundary atmospheric transport and that are likely to have significant adverse effects on human health or the environment.
(3) Il protocollo prevede la riduzione delle emissioni totali annue nell'atmosfera di cadmio, piombo e mercurio e l'applicazione di misure di controllo dei prodotti.	(3) The Protocol stipulates the reduction of total annual emissions into the atmosphere of cadmium, lead and mercury, and the application of product control measures.
(4) I provvedimenti previsti dal protocollo contribuiscono al conseguimento degli obiettivi della politica comunitaria in materia ambientale.	(4) The measures envisaged in the Protocol contribute to achieving objectives of the Community policy on environment.
(5) La Comunità e gli Stati membri cooperano, nell'ambito delle rispettive competenze, con i paesi terzi e le organizzazioni internazionali competenti.	(5) The Community and the Member States cooperate, in the framework of their respective competences, with non-member countries and the competent international organisations.
(6) È opportuno che la Comunità approvi il protocollo,	(6) The Community should approve the Protocol,
DECIDE:	HAS DECIDED AS FOLLOWS:
Articolo 1	Article 1
Il protocollo della convenzione del 1979 sull'inquinamento atmosferico transfrontaliero a grande distanza relativo ai metalli pesanti, firmato il 24 giugno 1998, è approvato a nome della Comunità.	The Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Heavy Metals, signed on 24 June 1998, is hereby approved on behalf of the European Community.
Il testo del protocollo è accluso alla presente decisione.	The text of the Protocol is attached to this Decision.
Articolo 2	Article 2
Il presidente del Consiglio è autorizzato a designare la (le) persona (persone) abilitata (abilitate) a depositare gli strumenti di approvazione presso il Segretario generale delle Nazioni Unite, a norma dell'articolo 16 del protocollo.	The President of the Council is hereby authorised to designate the person empowered to deposit the instrument of approval with the Secretary-General of the United Nations, in accordance with Article 16 of the Protocol.

La presente decisione è pubblicata nella Gazzetta ufficiale delle Comunità europee.	This Decision will be published in the Official Journal of the European Communities.
