Having regard to the Treaty establishing the European Community,

vista la direttiva 91/414/CEE del Consiglio, del 15 luglio 1991, relativa all'immissione in commercio dei prodotti fitosanitari [1], in particolare l'articolo 6, paragrafo 1,

Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market [1], and in particular Article 6(1) thereof,

considerando quanto segue:

(1) I regolamenti (CE) n. 451/2000 [2] e n. 703/2001 [3] della Commissione recano le disposizioni d'attuazione della seconda fase del programma di lavoro di cui all'articolo 8, paragrafo 2, della direttiva 91/414/CEE, e fissano un elenco di sostanze attive da valutare ai fini della loro eventuale iscrizione all'allegato I della direttiva 91/414/CEE. Tale elenco comprende il tribenuron.

(1) Commission Regulations (EC) No 451/2000 [2] and (EC) No 703/2001 [3] lay down the detailed rules for the implementation of the second stage of the programme of work referred to in Article 8(2) of Directive 91/414/EEC and establish a list of active substances to be assessed, with a view to their possible inclusion in Annex I to Directive 91/414/EEC. That list includes tribenuron.

(2) Gli effetti di questa sostanza attiva sulla salute umana e sull'ambiente sono stati valutati in conformità delle disposizioni dei regolamenti summenzionati per diversi impieghi proposti dai notificanti. Inoltre tali regolamenti designano lo Stato membro relatore che deve presentare all’Autorità europea per la sicurezza alimentare il relativo rapporto di valutazione e le raccomandazioni, ai sensi dell'articolo 8, paragrafo 1, del regolamento (CE) n. 451/2000. Per il tribenuron (in forma di tribenuron-metile) lo stato relatore era la Svezia, e tutte le informazioni pertinenti sono state presentate il 19 giugno 2003.

(2) For tribenuron the effects on human health and the environment have been assessed in accordance with the provisions laid down in Regulations (EC) No 451/2000 and (EC) No 703/2001 for a range of uses proposed by the notifiers. Moreover, those regulations designate the Rapporteur Member States which have to submit the relevant assessment reports and recommendations to the European Food Safety Authority (EFSA) in accordance with Article 8(1) of Regulation (EC) No 451/2000. For tribenuron (in the form of tribenuron-methyl) the Rapporteur Member State was Sweden and all relevant information was submitted on 19 June 2003.

(3) Il rapporto di valutazione è stato esaminato dai pari dell’AESA – in seno al gruppo di lavoro "valutazione" – e degli Stati membri, e presentato alla Commissione il 19 ottobre 2004 sotto forma di rapporto scientifico dell’AESA per il tribenuron [4]. Tale rapporto è stato riesaminato dagli Stati membri e dalla Commissione nell'ambito del comitato permanente per la catena alimentare e la salute degli animali e finalizzato sotto forma di rapporto di riesame della Commissione per il tribenuron.

(3) The assessment report has been peer reviewed by the Member States and the EFSA within its Working Group Evaluation and presented to the Commission on 19 October 2004 in the format of the EFSA Scientific Report for tribenuron [4]. This report has been reviewed by the Member States and the Commission within the Standing Committee on the Food Chain and Animal Health and finalised on 15 February 2005 in the format of the Commission review report for tribenuron.

(4) Dalle valutazioni effettuate è lecito supporre che i prodotti fitosanitari contenenti tribenuron possano soddisfare, nelle linee generali, i requisiti di cui all'articolo 5, paragrafo 1, lettere a) e b), della direttiva 91/414/CEE, in particolare per quanto riguarda gli usi presi in considerazione e specificati nel rapporto di riesame della Commissione. È quindi opportuno iscrivere il tribenuron nell’allegato I, affinché in tutti gli Stati membri le autorizzazioni per i prodotti fitosanitari contenenti detta sostanza attiva possano essere concesse conformemente alle disposizioni della summenzionata direttiva.

(4) It has appeared from the various examinations made that plant protection products containing tribenuron may be expected to satisfy, in general, the requirements laid down in Article 5(1)(a) and (b) of Directive 91/414/EEC, in particular with regard to the uses which were examined and detailed in the Commission review report. It is therefore appropriate to include tribenuron in Annex I, in order to ensure that in all Member States the authorisations of plant protection products containing this active substance can be granted in accordance with the provisions of that Directive.

(5) È opportuno accordare un lasso di tempo ragionevole prima che una sostanza attiva venga iscritta all'allegato I, onde consentire agli Stati membri e alle parti interessate di prepararsi ad ottemperare ai nuovi requisiti derivanti dall'iscrizione.

(5) A reasonable period should be allowed to elapse before an active substance is included in Annex I in order to permit Member States and the interested parties to prepare themselves to meet the new requirements which will result from the inclusion.

(6) Una volta effettuata l'iscrizione, gli Stati membri dovranno disporre di un congruo periodo per riesaminare le autorizzazioni esistenti relative a prodotti fitosanitari contenenti tribenuron onde garantire il rispetto delle condizioni di cui alla direttiva 91/414/CEE, segnatamente dell’articolo 13 e delle condizioni specificate all'allegato I. Gli Stati membri dovrebbero modificare o ritirare, se del caso, le autorizzazioni esistenti o rilasciare nuove autorizzazioni ai sensi delle disposizioni della direttiva 91/414/CEE; ai fini dell'efficienza e tenuto conto del poco tempo a disposizione, è opportuno che lo Stato membro relatore coordini il riesame di cui sopra tra gli Stati membri. Occorre prevedere un periodo più lungo per la presentazione e la valutazione del fascicolo completo, previsto dall'allegato III, di ciascun prodotto fitosanitario conformemente ai principi uniformi di cui alla direttiva 91/414/CEE.

(6) Without prejudice to the obligations defined by Directive 91/414/EEC as a consequence of including an active substance in Annex I, Member States should be allowed a period of six months after inclusion to review existing authorisations of plant protection products containing tribenuron to ensure that the requirements laid down by Directive 91/414/EEC, in particular in its Article 13 and the relevant conditions set out in Annex I, are satisfied. Member States should vary, replace or withdraw, as appropriate, existing authorisations, in accordance with the provisions of Directive 91/414/EEC. By derogation from the above deadline, a longer period should be provided for the submission and assessment of the complete Annex III dossier of each plant protection product for each intended use in accordance with the uniform principles laid down in Directive 91/414/EEC.

(7) Le esperienze ottenute con le precedenti iscrizioni nell’allegato I della direttiva 91/414/CEE di sostanze attive valutate nel quadro del regolamento (CEE) n. 3600/92 della Commissione [5] hanno dimostrato che possono presentarsi difficoltà di interpretazione degli obblighi di chi detiene autorizzazioni esistenti in relazione all’accesso ai dati. Per evitare ulteriori difficoltà è quindi necessario chiarire gli obblighi degli Stati membri, specialmente quello di verificare che il titolare di un’autorizzazione dimostri l’accesso ad un fascicolo conforme alle prescrizioni dell’allegato II alla direttiva stessa. Tale chiarimento non impone nessun nuovo obbligo agli Stati membri o ai titolari di autorizzazioni rispetto alle direttive finora adottate e che emendano l’allegato I.

(7) The experience gained from previous inclusions in Annex I to Directive 91/414/EEC of active substances assessed in the framework of Commission Regulation (EEC) No 3600/92 [5] has shown that difficulties can arise in interpreting the duties of holders of existing authorisations in relation to access to data. In order to avoid further difficulties it therefore appears necessary to clarify the duties of the Member States, especially the duty to verify that the holder of an authorisation demonstrates access to a dossier satisfying the requirements of Annex II to that Directive. However, this clarification does not impose any new obligations on Member States or holders of authorisations compared to the directives which have been adopted until now amending Annex I.

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

L'allegato I della direttiva 91/414/CEE è modificato come specificato nell'allegato della presente direttiva.

Annex I to Directive 91/414/EEC is amended as set out in the Annex to this Directive.

Gli Stati membri adottano e pubblicano entro il 31 agosto 2006 le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni nonché una tavola di concordanza tra queste ultime e la presente direttiva.

Member States shall adopt and publish by 31 August 2006 at the latest the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between those provisions and this Directive.

Essi applicano dette disposizioni dal 1o settembre 2006.

They shall apply those provisions from 1 September 2006.

Quando gli Stati membri adottano tali disposizioni, queste devono contenere un riferimento alla presente direttiva od essere corredate di siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità del riferimento sono decise dagli Stati membri.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

1. In applicazione della direttiva 91/414/CEE gli Stati membri, qualora necessario, modificano o ritirano le autorizzazioni esistenti per fitofarmaci contenenti come sostanza attiva il tribenuron, entro il 31 agosto 2006.

1. Member States shall in accordance with Directive 91/414/EEC, where necessary, amend or withdraw existing authorisations for plant protection products containing tribenuron as an active substance by 31 August 2006.

Entro tale data essi verificano il rispetto delle condizioni dell’allegato a questa direttiva riguardanti il tribenuron, ad eccezione di quelle della parte B di iscrizioni delle sostanze attive in questione; gli Stati membri verificano anche che il titolare dell'autorizzazione possegga un fascicolo conforme alle prescrizioni dell'allegato II alla suddetta direttiva o ne abbia accesso, conformemente alle condizioni dell'articolo 13 della direttiva stessa.

By that date they shall in particular verify that the conditions in Annex I to that Directive relating to tribenuron are met, with the exception of those identified in part B of the entry concerning that active substance, and that the holder of the authorisation has, or has access to, a dossier satisfying the requirements of Annex II to that Directive in accordance with the conditions of Article 13 of that Directive.

2. In deroga al paragrafo 1, ciascun prodotto fitosanitario autorizzato contenente il tribenuron come unica sostanza attiva presente o in miscela con una delle sostanze attive iscritte nell'allegato I della direttiva 91/414/CEE entro il 28 febbraio 2006, forma oggetto di riesame da parte degli Stati membri conformemente ai principi uniformi di cui all'allegato VI della direttiva 91/414/CEE, sulla base di un fascicolo conforme ai requisiti dell'allegato III della suddetta direttiva e tenendo conto della parte B dell'allegato I di detta direttiva concernente il tribenuron. In base a tale riesame essi stabiliscono se il prodotto è conforme o meno alle condizioni di cui all'articolo 4, paragrafo 1, lettere b), c), d) ed e), della direttiva 91/414/CEE

2. By derogation from paragraph 1, for each authorised plant protection product containing tribenuron as either the only active substance or as one of several active substances all of which were listed in Annex I to Directive 91/414/EEC by 28 February 2006 at the latest, Member States shall re-evaluate the product in accordance with the uniform principles provided for in Annex VI to Directive 91/414/EEC, on the basis of a dossier satisfying the requirements of Annex III to that Directive and taking into account part B of the entry in Annex I to that Directive concerning tribenuron. On the basis of that evaluation, they shall determine whether the product satisfies the conditions set out in Article 4(1)(b), (c), (d) and (e) of Directive 91/414/EEC.

Sulla base di quanto stabilito, gli Stati membri:

Following that determination Member States shall:

a) nel caso di un prodotto contenente tribenuron come unica sostanza attiva, ove necessario modificano o revocano l'autorizzazione entro il 28 febbraio 2010; o

(a) in the case of a product containing tribenuron as the only active substance, where necessary, amend or withdraw the authorisation by 28 February 2010 at the latest; or

b) nel caso di prodotti contenenti tribenuron come sostanza attiva in combinazione con altre, ove necessario modificano o revocano l'autorizzazione entro il 28 febbraio 2010 ovvero entro il termine, qualora più esteso, fissato per la modifica o la revoca in parola rispettivamente dalla direttiva o dalle direttive che hanno iscritto la sostanza o le sostanze nell'allegato I della direttiva 91/414/CEE.

(b) in the case of a product containing tribenuron as one of several active substances, where necessary, amend or withdraw the authorisation by 28 February 2010 or by the date fixed for such an amendment or withdrawal in the respective Directive or Directives which added the relevant substance or substances to Annex I to Directive 91/414/EEC, whichever is the latest.

La presente direttiva entra in vigore il 1o marzo 2006.

This Directive shall enter into force on 1 March 2006.
