IL CONSIGLIO DELL'UNIONE EUROPEA,

THE COUNCIL OF THE EUROPEAN UNION,

visto il trattato che istituisce la Comunità europea,

Having regard to the Treaty establishing the European Community,

vista la direttiva 2000/29/CE del Consiglio, dell' 8 maggio 2000, concernente le misure di protezione contro l'introduzione nella Comunità di organismi nocivi ai vegetali o ai prodotti vegetali e contro la loro diffusione nella Comunità [1], in particolare l'articolo 14, paragrafo 2, lettera d),

Having regard to Council Directive 2000/29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community [1], and in particular point (d) of the second paragraph of Article 14 thereof,

vista la proposta della Commissione,

Having regard to the proposal of the Commission,

considerando quanto segue:

(1) La direttiva 2004/102 /CE [2] modifica gli allegati II, III, IV e V della direttiva 2000/29/CE. Gli Stati membri devono applicarla entro il 1o marzo 2005.

(1) Directive 2004/102/EC [2] amends Annexes II, III, IV and V to Directive 2000/29/EC and is to be implemented by the Member States by 1 March 2005.

(2) La direttiva 2004/102 /CE contiene disposizioni concernenti il legno e i prodotti di legno. I provvedimenti relativi a palette, cassette e paglioli allineano le disposizioni comunitarie alla norma internazionale FAO per le misure fitosanitarie (ISPM) n. 15 sugli orientamenti per la regolamentazione del materiale da imballaggio in legno negli scambi internazionali, adottata nel marzo del 2002 dalla quarta commissione ad interim sulle misure fitosanitarie (ICPM).

(2) Directive 2004/102/EC contains provisions related to wood and wood products. The measures related to pallets, boxes and dunnage align Community measures with the FAO International Standard for Phytosanitary Measures (ISPM) No 15 on "Guidelines for regulating wood packaging material in international trade" which was adopted in March 2002 by the Fourth Interim Commission on Phytosanitary Measures (ICPM).

(3) La norma n. 15 stabilisce che gli imballaggi (compresi i paglioli) in legno grezzo di conifere o altro vadano sottoposti a provvedimenti approvati come il trattamento termico (56 Â°C per almeno 30 minuti) o la fumigazione con bromuro di metile. Il legno dovrebbe inoltre essere contrassegnato da un marchio specifico che certifichi che il medesimo è stato oggetto di un provvedimento approvato.

(3) Standard No 15 describes that wood packaging (including dunnage) made of coniferous and non-coniferous raw wood, should be subjected to approved measures such as heat treatment (56 Â°C for a minimum of 30 minutes) or fumigation with Methyl Bromide. Moreover the wood should display a specified mark to certify that the wood has been subjected to an approved measure.

(4) La norma stabilisce inoltre che i paesi possano richiedere che il materiale da imballaggio in legno importato, oggetto di un provvedimento approvato, sia ottenuto da legname scortecciato, in funzione di una "giustificazione tecnica", e contrassegnato da un marchio.

(4) The Standard also provides that countries may require that imported wood packaging material subjected to an approved measure be made from debarked wood and display a mark subject to "technical justification".

(5) Alcuni paesi terzi hanno chiesto che la Comunità consideri metodi alternativi per conseguire il medesimo obiettivo. A tal fine sono in corso ricerche sugli aspetti tecnici della scortecciatura del legno, in particolare per quanto riguarda l'efficacia in termini di "riduzione del rischio di parassiti" se associata a trattamenti.

(5) Third countries have requested that the Community consider alternative methods of achieving the same goal. To this end, research is under way on technical aspects of debarking wood, in particular the efficiency of "pest risk reduction" of debarking in addition to treatment measures.

(6) In attesa dei risultati di tali ricerche è opportuno differire l'applicazione di tale prescrizione per il legno scortecciato.

(6) While awaiting the results of that research, it is appropriate to postpone for debarked wood, the application of the requirement to be used.

(7) àˆ opportuno quindi modificare di conseguenza la direttiva 2000/29/CE.

HA ADOTTATO LA PRESENTE DIRETTIVA:

HAS ADOPTED THIS DIRECTIVE:

La direttiva 2000/29/CE è modificata come segue:

Directive 2000/29/EC is amended as follows:

1) Nell'allegato IV, parte A, sezione I, punto 2, alla fine della colonna di destra è aggiunto il paragrafo seguente:

1. In Annex IV, Part A, section I, point 2, the following paragraph shall be added at the end of the right hand column:

"Il primo trattino, in cui si stabilisce che il materiale da imballaggio in legno debba essere ottenuto da legname rotondo scortecciato, si applica solo a decorrere dal 1o marzo 2006."

"The first indent, requiring wood packaging material to be made from debarked round wood, shall only apply from 1 March 2006."

2) Nell'allegato IV, parte A, sezione I, punto 8, alla fine della colonna di destra è aggiunto il paragrafo seguente:

2. In Annex IV, Part A, section I, point 8, the following paragraph shall be added at the end of the right hand column:

"La prima riga della lettera a), in cui si stabilisce che il materiale da imballaggio in legno debba essere ottenuto da legname rotondo scortecciato, si applica solo a decorrere dal 1o marzo 2006.".

1. Gli Stati membri adottano e pubblicano entro il 28 febbraio 2005 le disposizioni legislative, regolamentari e amministrative necessarie per conformarsi alla presente direttiva. Essi comunicano immediatamente alla Commissione il testo di tali disposizioni nonché una tavola di concordanza tra queste ultime e la presente direttiva.

1. Member States shall adopt and publish, not later than 28 February 2005, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions and a correlation table between these provisions and this Directive.

Essi applicano tali disposizioni a decorrere dal 1o marzo 2005.

They shall apply these provisions from 1 March 2005.

Quando gli Stati membri adottano tali disposizioni, queste contengono un riferimento alla presente direttiva o sono corredate di un siffatto riferimento all'atto della pubblicazione ufficiale. Le modalità di tale riferimento sono decise dagli Stati membri.

When Member States adopt these provisions, they shall contain a reference to this Directive or shall be accompanied by such a reference on the occasion of their official publication. The methods of making such reference shall be laid down by the Member States.

2. Gli Stati membri comunicano alla Commissione il testo delle disposizioni essenziali di diritto interno che essi adottano nel settore disciplinato dalla presente direttiva.

2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.

La presente direttiva entra in vigore il terzo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.

This Directive shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

Gli Stati membri sono destinatari della presente direttiva.

This Directive is addressed to the Member States.
